Maharashtra Announces Major Stamp Duty Relief for 600 Sq Ft Cluster Redevelopment Flats in Mumbai

The Maharashtra government has reportedly introduced a significant stamp duty concession for cluster redevelopment projects within Mumbai's municipal limits, a move aimed at alleviating financial burdens on residents and accelerating stalled housing initiatives across the city.

According to industry sources, the decision was formalized through a circular issued by the Inspector General of Registration and Controller of Stamps following approval from the state's Revenue Department on November 23.

Key Features of the New Stamp Duty Concession Policy

The stamp duty relief in Maharashtra applies specifically to flats up to 600 square feet that are received through cluster redevelopment schemes. The eligible area encompasses the original carpet area, additional area received based on cluster size, and fungible area representing extra construction rights granted under development regulations.

Under the new framework, stamp duty will reportedly be charged at a concessional rate calculated at 112 times the rent or an applicable lower rate, replacing the earlier valuation methods based on Ready Reckoner rates or construction costs. This change is expected to generate substantial cost savings, with estimates suggesting approximately ₹21 lakh per one-acre plot and around ₹4 crore per five-hectare development.

Accelerating Urban Renewal Initiatives in Mumbai

The policy aims to inject fresh momentum into pending and stalled redevelopment projects across Mumbai, particularly in aging precincts where tenants and housing societies have faced significant cost barriers due to elevated stamp duty charges on increased built-up areas.

According to DCPR 2034 Rule 33(9)(5)(i), eligible tenants are entitled to a minimum carpet area of 35 square meters (approximately 376 square feet) in cluster redevelopment schemes. The latest concession reportedly allows residents to receive an increased net area of up to 200 square feet while substantially reducing their registration costs.

A senior state Revenue Minister noted that this policy provides critical financial relief and essential support for ongoing redevelopment efforts in Maharashtra, enabling more housing societies to participate in urban renewal programs.

Industry Calls for Broader Stamp Duty Exemptions

A senior legislator and chairperson of the Maharashtra Housing Self/Group Redevelopment Authority has reportedly urged the government to extend the stamp duty exemption to all tenements up to 600 square feet across all redevelopment schemes, not limiting it exclusively to cluster projects.

Sources indicate that a formal recommendation letter advocating for this broader waiver has been submitted to the Revenue Department for consideration, which could potentially benefit thousands more residents across the state.

Addressing Long-Standing Redevelopment Challenges

Cluster redevelopment projects in Mumbai, especially in high-density zones, have historically faced numerous delays stemming from land acquisition complications, funding constraints, and escalating construction costs. The new concession is expected to address several critical issues in the Mumbai real estate market.
