Maharashtra - Cooperative Housing Redevelopment

In a strategic move to catalyze the redevelopment of aging cooperative society buildings, the Maharashtra state cabinet, in a meeting held recently, sanctioned a crucial amendment to a longstanding law. This change empowers the eviction of homeowners who, despite being in the minority, obstruct redevelopment plans approved by the majority.

Streamlining the Redevelopment Process

A high-ranking official from the Chief Minister's Office revealed that this modification to the Maharashtra Apartment Ownership Act of 1970 is anticipated to significantly speed up the redevelopment procedures for buildings registered under the Act. This follows a previous amendment from July 7, 2018, which required the consent of at least 51 percent of apartment owners for redevelopment. However, the Act lacked clarity on how to handle dissenting members who hindered progress by refusing to vacate. This latest cabinet decision effectively addresses this gap.
