Residents of the Trident Galaxy apartment complex in Bhubaneswar have accused the developer of forcibly occupying and altering areas designated as common property. The allegations, filed as a formal complaint with city authorities, have triggered both legal and civic responses, including a silent protest by residents.

Complaint Highlights Illegal Occupation

The dispute has unfolded in Kalinga Nagar, where apartment owners have claimed that the developer carried out unauthorized actions on May 23. According to a report by The Times of India, the developer is said to have entered the residential premises, demolished a boundary wall and gate, and initiated road construction toward a separate under-construction project of around 600 units.

Residents allege that the disputed portion falls under their designated common area, which legally belongs to the registered association of allottees. They contend that the developer has no authority to alter or utilize this space for commercial interests.

Violation of the Odisha Apartment Act, 2023

The residents have cited the Odisha Apartment (Ownership and Management) Act, 2023, which mandates that all common areas be handed over to the apartment owners' association. Despite the formal registration of the association, the developer is alleged to have withheld this transfer, continuing to use the common spaces for personal or commercial benefit.

Furthermore, the builder is reportedly ignoring an existing stay order issued by the court, which prohibits any construction activity within the disputed area. This defiance has added to the residents' concerns over the legality of the ongoing work.

Silent Protest and Administrative Response

As part of their protest, residents conducted a silent demonstration earlier this month, urging authorities to enforce the law and facilitate the transfer of common areas. Having initially sought help from the local police without success, the residents eventually approached the executive magistrate for intervention.

In response, an interim order was issued by the executive magistrate, instructing both parties to refrain from any modifications to the common property. The local police have been directed to ensure the disputed area remains undisturbed until a final resolution is reached.
