In a significant relief for residents of MCOR Apartments in Ameenpur, the Telangana State Real Estate Regulatory Authority (TG RERA) has issued firm directives to the developer, MCOR LLP Projects, to transfer physical possession of all common areas of the project to the residents' association.

Strict Compliance with Sanctioned Layout Ordered

The TG RERA order, dated May 17, instructed the developer to strictly abide by the sanctioned plans as approved by the competent authority. Any deviation from these approved layouts would lead to penal consequences under the provisions of the RERA Act, 2016.

Further, the regulatory authority barred MCOR LLP from interfering with the administration or use of the common areas, which now lawfully belong to the MCOR Apartment Association, following the issuance of the occupancy certificate.

Parking Dispute and Residents’ Complaint

The order came in response to complaints filed by apartment residents who are also the project allottees of 'Darbar'—a residential complex developed by MCOR LLP. According to the sanctioned layout, each flat was supposed to receive a dedicated parking space of 125 square feet. However, the developer had allotted only 100 square feet per unit and allegedly carved out five additional parking slots, which were then sold to other residents.

This unauthorized reduction in space not only caused inconvenience to original buyers but also sparked concerns over transparency and fairness in project delivery.

Occupancy Certificate Received, but Issues Persist

The residents had obtained the occupancy certificate as early as June 2023. However, they alleged that the developer continued to control the common parking area, flouting approved plans and even going to the extent of threatening to occupy the children’s play area for personal use.

The complainants appealed to TG RERA to reassign the five extra parking slots back to the association as originally planned.

Final Directive to Developer

After reviewing the case, TG RERA concluded that the stilt floor of the complex must contain exactly 25 parking spaces as per the sanctioned layout. The developer has been directed to follow the original plan without deviation and to hand over the common areas accordingly.

This order was jointly issued by TG RERA chairman N. Satyanarayana and members K. Srinivasa Rao and Laxminarayana Jannu, reinforcing the importance of regulatory compliance in real estate projects.
