Occupancy Certificate Not Required For Deemed Conveyance in Maharashtra

State cooperation department officials recently stated that a building's occupancy certificate (OC) is not necessary for housing societies to apply for and receive deemed conveyance, citing a little-known government resolution (GR) of 2018 that was enacted to expedite deemed conveyance for housing societies in Maharashtra.

A self-declaration form signed by the housing society's representatives stating that the organisation intends to pay the necessary costs and get OC from the relevant authorities is a prerequisite for receiving the facility.

Authorities in Maharashtra believe that the low rate of societies seeking deemed conveyance without OC is due to a lack of awareness about the GR.

By GR dated June 22, 2018, societies without OC were allowed to apply for deemed conveyance online or offline, after completing a self-declaration form.

There are an estimated 70,000 housing societies that are old and do not possess deemed conveyance in Maharashtra. As per the officials of the department a majority of such buildings are without occupation Certificates.
